It was with sadness that I read that Terry de March will be stepping down as Director General of the Charities Directorate. Thankfully he is not going far. While Terry de March is leaving his position of Director General, Charities Directorate, he will be remaining at the CRA as a Special Advisor to the Assistant Commissioner of the Legislative Policy and Regulatory Affairs Branch of the CRA, continuing to support the ongoing development of the charities regulatory program.

The CRA in June released their “Consultation on the Proposed Guidance on Activities Outside of Canada for Canadian Registered Charities”. It depends. The Charities Directorate Information Circular IC 75-23 (Tuition Fees and Charitable Donations paid to privately supported secular and religious schools) is located at http://www.cra-arc.gc.ca/E/pub/tp/ic75-23/ic75-23-e.txt and it sets out the CRA administrative policy with respect to when and how Canadian charities that have religious schools may issue official donation receipts. Generally, tuition fees paid to a charity are not considered a “gift” but CRA has allowed an exception for “religious schools” that teach exclusively religion like a Sunday school and another exception in certain circumstances for dual capacity schools that provide both secular and religious education like a religious day school.
