The ONCA received Royal Assent on October 25, 2010. It has not yet come into force. The Ontario Government was targeting implementation of the ONCA for January 1, 2013. Today the Ontario Government announced that their target date for implementation has changed to July 1, 2013. The Ministry of Consumer Services (MCS) and the Ministry of Government Services (MGS) are working on the ONCA.
The Ontario Government noted “While the government anticipated that ONCA would come into force on January 1st, 2013, it is now targeted to come into force on July 1st, 2013. This will allow the sector more time to ensure a smooth implementation.”
The government also noted that they will soon be providing:
“• Plain language guide that explains sections that will likely have the most impact
• Transition checklist to help ensure compliance with ONCA
• Draft default by-law to help existing not-for-profit corporations review and make any necessary changes to their by-laws during the transition
These tools, and additional information, are targeted to be posted on the Ministry of Consumer Services’ website beginning in Fall 2012.”
