The Ontario Ministry of Consumer Services has provided an update today on the implementation status of the Not-for-Profit Corporations Act, 2010 (ONCA). The Ministry notes: “The Act is targeted to come into effect in 2014. Amendments to more than 80 statutes including the Act were introduced in the legislature in June 2013. It is anticipated that these amendments will be debated in the legislature in fall 2013. If the amendments are passed by the legislature, the Act is anticipated to come into force no earlier than six months after passage in order to ensure adequate time for not-for-profit corporations to prepare for transition.” In other words the ONCA is slated probably to come into effect around July 1, 2014!
The Ministry has also released an electronic toolkit and the material can be accessed by requesting copies by email at ONCAtools@ontario.ca. The toolkit includes presentation slides, speaking points, presenter questions and answers, newsletter and bulletin articles of varying lengths, web text of varying lengths and Facebook posts. These documents can be used by a not-for-profit to explain the ONCA to its members and stakeholders. For more information on the ONCA, you can take a look at the Ministry’s website at: http://www.sse.gov.on.ca/mcs/en/Pages/Not_For_Profit.aspx.
The Ministry has advised that CLEO (Community Legal Education Ontario), which was created to provide support to not-for-profit corporations making the transition to the ONCA, has now launched the “Get Ready for the ONCA Project”. This project will assist not-for-profit corporations in Ontario in preparing for the ONCA. Any inquiries about this project can be sent to oncainfo@cleo.on.ca.
